Member of Parliament for Walewale Constituency Dr. Mahama Tiah Abdul Kabiru has raised strong opposition to the recent High Court ruling that object the prosecutorial powers of the Office of the Special Prosecutor (OSP).
In an interview with Radio Tamale on Wednesday, April 22, 2026, Dr. Kabiru argued that the court's decision undermines the constitutional powers of the Special Prosecutor, asserting that the office lacks the authority to prosecute cases without directives from the Attorney General emphasizing that it is the Attorney General’s constitutional duty to oversee and take control of all criminal cases investigated by the OSP.
The MP highlighted that the stance of the minority in Parliament considers the ruling by the High Court a significant setback to good governance and the fight against corruption. He described it as a “scaffold on the conscience of good governance” and an obstacle to ongoing anti-corruption efforts.
The Minority in Parliament in its press conference insist that the prosecution powers of the Office of the Special Prosecutor remain lawful.
They have called for urgent legal measures, including the immediate appeal of the High Court decision, an application for a stay of execution, and proceeding to the Supreme Court with a writ of certiorari to quash the ruling.
Dr. Mahama Tiah concluded by emphasizing the importance of maintaining the independence of the Office of the Special Prosecutor, especially in the ongoing fight against corruption.
The minority’s stance underscores a call for urgent judicial review to uphold the rule of law and ensure the effectiveness of anti-corruption institutions.
